Genga & Associates,
P.C. represents clients in civil matters (as defendant or plaintiff)
in various federal trial and appellate courts, including the Central
and Northern District Courts of California, appellate courts in
the Ninth and Federal Circuits, and the United States Supreme Court,
in addition to representation in California state court and commercial
arbitration forums. Our staff has extensive experience in all aspects
of federal and state commercial litigation. Representations include
routine lawsuits, as well as matters of extraordinary complexity,
such as mutli-tiered commercial litigation involving issues of contract
enforcement and related business torts, including fraud, interference,
trade secret misappropriation, trade libel, federal and state unfair
competition and breaches of the implied covenant of good faith and
fair dealing; entertainment issues, such as copyright infringement,
trademark infringement, passing off, federal false designation of
origin claims, rights of publicity and privacy, implied contract/idea
submission claims, film and television financing agreements, and
royalty/accounting disputes; and technology related litigation involving
copyrights and/or the DMCA, patents, trademarks, open source software
licenses, Internet domain names, trade secret misappropriation,
microchip "mask" works, technology contracts, venture
capital/startup financing disputes, CAN-SPAM defense, electronic
discovery and e-evidence, Internet-related defamation claims, and
online identity theft/phishing scams. Our litigation practice also
integrates relationships with foreign law firms (China in particular),
expanding the reach of our practice and the types of services that
we can provide.
Our litigation clients expect (and
get) sound advice, creative strategies that help manage costs but
garner positive results. We always operate with a cost-conscious
mentality, whether attempting to reach an informal out-of-court
settlement at an early stage in the litigation (which, unlike many
large, uber-litigious firms, we see as a successful outcome) or
pursuing aggressive representation in pre-trial proceedings, at
trial or during the appellate process.
